Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Filip Bochenek, a natural person established in Poland and operating the Service under the brand "BioStack" ("BioStack", "we", "our", "us") governing your access to and use of the BioStack Intelligence application, website, APIs, and related services (collectively, the "Service"). By creating an account, signing in, or otherwise using the Service, you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy, Acceptable Use Policy, and Health & Safety Disclaimer. If you do not agree, you may not use the Service.

These Terms also constitute the regulations ("regulamin") for the provision of services by electronic means within the meaning of the Polish Act of 18 July 2002 on Provision of Services by Electronic Means (Dz.U. 2002 Nr 144, poz. 1204, as amended).

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) and legally able to enter into a binding contract. By using the Service, you represent that you meet these requirements.

2. Your account

• You are responsible for safeguarding your credentials and for all activity under your account.
• You must provide accurate information. Health inputs that are materially incorrect can produce unsafe recommendations.
• We may suspend or terminate accounts that violate these Terms or that pose risk to the Service, other users, or us.

3. Nature of the Service

BioStack is an educational and harm-reduction tool. It is not medical care, is not supervised by a licensed clinician acting on your behalf, and is not a substitute for a doctor-patient relationship. See our Health & Safety Disclaimer for full details.

4. Subscriptions and billing

• Paid plans renew on the interval you select (monthly or annually) until you cancel. Cancellations take effect at the end of the then- current billing period.
• Fees are non-refundable except where required by law. Taxes are your responsibility where applicable.
• We may change prices or features with reasonable notice. Changes apply at the start of the next billing cycle.

5. Acceptable use

Use of the Service is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. In particular, you may not use the Service to commit fraud, to harm others, to distribute controlled substances, to scrape or reverse-engineer our systems, or to violate any law.

6. User content

Content you submit (stack entries, bloodwork, conversations, notes) remains yours. You grant us a non-exclusive, worldwide, royalty-free license to host, process, and display your content as necessary to operate and improve the Service. We use aggregated and de-identified data to improve safety models; we do not sell your data.

7. AI-generated content

The Service includes large-language-model (LLM) features that produce responses probabilistically. Output can be wrong, incomplete, or fabricated. You are responsible for independently verifying anything you act on.

8. Intellectual property

The Service, its code, UI, content, trademarks, and underlying models are owned by BioStack or its licensors. No rights are granted except as expressly stated in these Terms.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access for breach, risk, or legal reasons. Sections that by their nature should survive termination (including Sections 6, 10–13) will survive.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIOSTACK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ACCURATE, OR SAFE FOR ANY PARTICULAR USE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIOSTACK'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE AND (B) USD $100. BIOSTACK WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, EVEN IF ADVISED OF THE POSSIBILITY.

12. Indemnification

You will defend, indemnify, and hold harmless BioStack and its personnel from any claim, loss, or expense (including reasonable attorneys' fees) arising from your use of the Service, your content, or your breach of these Terms.

13. Governing law & disputes

These Terms are governed by the laws of the Republic of Poland. Any dispute arising out of or relating to the Service or these Terms shall be heard by the Polish courts having jurisdiction over the Service operator's place of residence, except where mandatory law gives a consumer the right to bring proceedings before the courts of their country of residence — in which case that right is preserved.

Nothing in these Terms restricts your statutory rights as a consumer under Polish law, EU law (including Regulation (EU) 2016/679 — RODO/GDPR), or any other mandatory consumer-protection law applicable to you. To the extent any provision of these Terms conflicts with such mandatory rights, the mandatory rights prevail and the rest of the Terms remain in force. Polish consumers may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

Note on digital-content withdrawal: where you purchase a paid subscription, you acknowledge under Article 38 of the Consumer Rights Directive (and Polish implementation thereof) that the Service is supplied as digital content and that, by using the Service immediately after subscribing, you consent to performance beginning before the 14-day withdrawal period expires and accordingly lose your right to withdraw under Polish consumer law. You retain full rights of cancellation for future billing periods per Section 4.

14. Changes

We may update these Terms. When we do, we will bump the version and require you to re-accept before continuing to use the Service. Continued use after re-acceptance constitutes agreement to the updated Terms.
